Personas en trámite de jubilación podrán transferir Fondos a cuenta corriente a contar del 1 de mayo
La Superintendencia de Pensiones (SP) emitió una nueva norma de carácter general, cuyo objetivo es permitir que quienes se encuentren en trámite de jubilación puedan transferir sus ahorros previsionales hacia una cuenta corriente de los fondos de pensiones. El objetivo es evitar que los ahorros de las personas se vean afectados por las variaciones en la rentabilidad de las inversiones, para lo cual establece que una persona puede acogerse a esa opción en cualquier momento del trámite de pensión.
Las nuevas regulaciones de la autoridad modifican el Compendio de Normas del Sistema de Pensiones y entrarán en vigencia el 1 de mayo de 2020.
Según los datos de la SP, en 2019 se pensionaron 123.939 personas por vejez, otras 12.089 por invalidez y 21.428 por sobrevivencia. Al cierre del primer trimestre de 2020, los pensionados por vejez sumaban 32.206 personas, mientras que por invalidez 226 personas y otras 3.927 personas por sobrevivencia.
Dado lo anterior, se estima que la nueva norma de la Superintendencia de Pensiones podría beneficiar a unos 150.000 afiliados y afiliadas por año.
En la actualidad, desde la fecha de solicitud de pensión hasta la fecha de otorgamiento de aquella, el saldo para pensión de los afiliados y beneficiarios puede variar positiva o negativamente, dependiendo de las fluctuaciones del mercado financiero en el que se encuentran invertidos los fondos previsionales. Esto implica que afiliados y beneficiarios no tienen certeza sobre cuál será su saldo final al momento del cálculo de su pensión.
Por lo mismo, según la SP, no es deseable que debido a las fluctuaciones de rentabilidad durante la tramitación de la solicitud de pensión, aquel saldo pueda resultar disminuido y, con eso, impacte negativamente el monto de la pensión.
Dado lo anterior, la nueva norma establece que el afiliado o sus beneficiarios, al momento de efectuar la solicitud de pensión de vejez, invalidez o sobrevivencia, puedan pedir a su AFP que transfiera hacia una cuenta corriente de los fondos de pensiones, todo el saldo de ahorro previsional que destinarán a pensión.
El objetivo es que esos recursos se mantengan sin variación a la fecha en que se realiza la solicitud de pensión y hasta la fecha en que le sea concedida o que desista de ella. En el caso de las pensiones de sobrevivencia, la opción por mantener el saldo destinado a pensión en la mencionada cuenta corriente deberá ser expresada, de común acuerdo por todos los beneficiarios, al momento de realizar la solicitud de pensión de sobrevivencia.
EL PROCEDIMIENTO En la nueva norma, la Superintendencia señala eplícitamente que la opción de destinar los ahorros previsionales a una cuenta corriente de los fondos de pensiones estará vigente solo hasta que el afiliado o afiliada seleccione la modalidad de pensión, o desista de pensionarse.
Efectuada la selección de modalidad de pensión de retiro programado o renta temporal, o el desistimiento del trámite de pensión, la norma indica que el saldo que permaneció en la cuenta corriente deberá volver al fondo o a los fondos en que se encontraba al momento de ser traspasado a la mencionada cuenta corriente, o a los fondos de pensiones que seleccione el afiliado o sus beneficiarios, sujeto a las restricciones legales vigentes. La legislación señala que los pensionados pueden mantener su saldo en los fondos tipo C, D y E.
Si el afiliado selecciona una renta vitalicia inmediata, la administradora deberá traspasar el monto de la prima contratada a la respectiva compañía de seguros.
Para lo anterior, la Superintendencia indica que la administradora deberá diseñar un formulario específico que deberá estar disponible en medios electrónicos para que filiados y beneficiarios puedan ejercer la opción de transferir sus ahorros destinados a pensión, hacia la mencionada cuenta corriente. Dicho formulario deberá ser presentado por el afiliado o los beneficiarios durante el trámite de pensión.
