Fiscalía investigó delito de homicidio calificado ocurrido en Vallenar y obtuvo condena de 4 acusados
*Caso fue desarrollado en audiencia de Juicio Oral por el fiscal jefe de esta comuna, Nicolás Zolezzi Briones, quien logró acreditar la autoría material y participación de todos los acusados por este crimen ocurrido en el mes diciembre del año 2018.
La Fiscalía de Atacama obtuvo en audiencia de Juicio Oral veredicto condenatorio en contra de cuatro acusados, a quienes investigó por su autoría y participación en un delito de homicidio calificado ocurrido en el mes de diciembre del año 2018 en la comuna de Vallenar.
La dirección de la investigación de este caso estuvo a cargo del fiscal jefe de esta comuna, Nicolás Zolezzi Briones, quien trabajó junto a funcionarios de la Brigada de Homicidios de Copiapó y peritos de Lacrim de Copiapó, La Serena y Santiago, luego de analizar una multiplicidad de peritajes y otros medios de prueba reunidos durante el desarrollo de las diligencias de investigación; las que permitieron formular acusación en contra de cuatro imputados, quienes de acuerdo a la investigación tuvieron participación en la muerte de la víctima, identificada como Sebastián Cisterna Vergara.
De acuerdo a los argumentos expuestos por el fiscal Zolezzi en la audiencia de juicio oral, el 15 de diciembre del mencionado año, alrededor de las 5 de la madrugada, uno de los condenados, Carlos Tapia Vergara, sostuvo una discusión con un grupo de personas que estaban en el interior de un domicilio ubicado en calle Copiapó de esta ciudad. Luego de lo cual, éste se retiró del lugar no sin antes amenazar a las personas mencionando que “estaba cargado” y que volvería.
“La Fiscalía pudo acreditar, más allá de toda duda razonable, luego de una completa investigación, que esta persona precisamente caminó a una vivienda cercana y solicitó apoyo a otros dos acusados, Sergio Godoy Robledo y Donkan Gallardo Chacana, regresando los tres al lugar en que se había originado la discusión, portando Godoy Robledo una escopeta de su propiedad”, indicó el fiscal.
En el juicio, a partir de la rendición de prueba pericial, testimonial y documental, más evidencia material por parte de la Fiscalía, fue posible acreditar que los acusados llegaron al domicilio en que permanecía la víctima junto a otras personas. Una vez allí, Sergio Godoy apuntó con su arma a quienes estaban en el antejardín, mientras sus acompañantes le gritaban que disparará. Fue en esta dinámica en que el acusado percutó la escopeta en contra de la víctima, a una distancia aproximada de un metro y medio y en absoluta indefensión, quien murió debido a la gravedad de las lesiones sufridas. Luego, los agresores se dieron a la fuga, escondiendo el cuarto acusado, Juan Robledo Robledo, el arma utilizada en un canal de regadío teniendo pleno conocimiento de los hechos ocurridos momentos antes.
Con estos antecedentes la Fiscalía de Vallenar acusó en calidad de autores a los tres imputados mencionados por la muerte de la víctima, además del cuarto involucrado por su calidad de encubridor del homicidio. Delitos que fueron acreditados en el juicio, determinando los Jueces del Tribunal Oral condenar por su responsabilidad penal a Sergio Godoy, Carlos Tapia y Donkan Gallardo, quienes fueron condenados por su calidad de coautores materiales del delito consumado de homicidio calificado por alevosía. Además, Sergio Godoy fue declarado culpable como autor material de un delito de posesión y porte ilegal de arma de fuego. Finalmente, Juan Robledo fue condenado como encubridor del delito de homicidio calificado del mencionado hecho.
De acuerdo a lo señalado por el fiscal Nicolás Zolezzi, las penas concretas que deberán cumplir los cuatro condenados por estos hechos se conocerán en una audiencia de comunicación de sentencia, vía remota, que fue fijada para el próximo lunes.
