Fiscalía expuso a más de cien policías respecto de su actuación en la Ley de Entrevista Videograbada
*El trabajo de ambas policías al momento de recibir denuncias de niñas, niños y adolescentes víctimas de delitos graves, involucrará un cambio absoluto respecto del trabajo que se realiza en la actualidad. Esto porque desde el próximo 03 de junio se velará en todo momento los derechos y la integridad de las y los afectados.
La implementación de la Ley 21.057 de Entrevista Investigativa Videograbada involucrará el cambio en actuaciones frente a delitos que afecten a niñas, niños y adolescentes. Uno de ellos será el que deberán realizar ambas policías al momento de tomar conocimiento de un delito a través de la denuncia.
Frente a esta profunda modificación en los procesos vigentes en la actualidad, la Fiscalía de Atacama, junto a abogadas de la Fiscalía Nacional, realizaron una jornada de capacitación en la que más de un centenar de funcionarios de la PDI y Carabineros de toda la región pudieron conocer los protocolos de la nueva normativa en materia de denuncias.
En este sentido el jefe de la Unidad de Atención a Víctimas de la Fiscalía de Atacama, Marcelo Miranda, expuso que la Ley establece que NNA son personas sujetas de derecho, por lo que a partir del 03 de junio de este año habrá un cambio en favor de estas víctimas, tanto en el trato, atención y el abordaje de la investigación de su caso, además de la etapa judicial. “El artículo cuarto de la Ley de Entrevista Investigativa Videograbada determina el protocolo que regula la interacción inicial que los funcionarios encargados de recibir la denuncia, además de la prioridad que éstas deben tener y el lugar físico en que se deben realizar, el que será privado para resguardar a la víctima de cualquier agente externo que pueda contaminar su relato y por sobre todo evitar la victimización secundaria”, indicó Miranda.
Por su parte, la Coordinadora Nacional de la Fiscalía Nacional para la implementación de esta Ley, Erika Maira, indicó en la jornada que el texto legal fijó formas específicas para que los funcionarios reciban las denuncias. No pudiendo hacer preguntas inductivas ni ahondar en los hechos que afectaron a la víctima. “Las niñas, niños y adolescentes que concurran a los cuarteles policiales a denunciar delitos graves, establecidos en la Ley, deberán ser atendidos de forma prioritaria y un lugar especialmente habilitado que cumpla con las condiciones de privacidad y resguardo. Teniendo los funcionarios la obligación legal de hacer un registro íntegro del relato de la víctima”, indicó Maira.
Durante la capacitación se expuso que respecto de la interacción con las y los denunciantes, los policías deberán aplicar un cuestionario que está regulado y es uniforme para todos los casos, el que busca generar el espacio de confianza y confidencialidad propiciando que NNA entreguen de forma voluntaria su relato sin que sea interrogado por los funcionarios.
Finalmente, Marcelo Miranda indicó que actualmente existen permanentes reuniones de coordinación con las jefaturas de ambas instituciones, quienes han demostrado un alto interés por aclarar todas las dudas surgidas frente a la puesta en marcha de esta nueva herramienta investigativa.
