Fiscalía acreditó delitos reiterados: En juicio abreviado logra prisión efectiva de 3 años para imputado por microtráfico
La Fiscalía de Atacama, a través de un procedimiento abreviado, obtuvo una sentencia condenatoria en contra de un imputado de quien se establecieron reiterados delitos de microtráfico de droga en Copiapó.
La información fue conocida en audiencia realizada a través de videoconferencia, ocasión en que el fiscal Leonel Ibacache, argumentó los antecedentes de los hechos investigados y los medios de prueba reunidos. Mencionando que respecto del condenado, Abel Olivera Toledo (36), se indagaron distintos hechos en que de detectó la comercialización de pequeñas cantidades de droga.
El primero de ellos fue formalizado en el mes de mayo del año pasado, ocasión en que el imputado fue detenido por personal de Carabineros portando pasta base de cocaína dosificada y más de 400 mil pesos en la vía pública. Luego, en junio del mismo año, personal de la PDI realizó un procedimiento en el domicilio del condenado, lugar en que los funcionarios policiales detectaron la presencia de distintas dosis de marihuana y pasta base en varios lugares de la vivienda. Al mes siguiente, la misma persona vendió droga a un agente revelador de Carabineros motivando con ello un procedimiento de entrada y registro al domicilio, incautando los funcionarios otras dosis de pasta base, balanzas digitales y bolsas plásticas destinadas a la distribución de la droga.
La venta ilegal de pequeñas dosis de droga por parte del imputado continuó en el mes de febrero de este año 2020, lo que quedó de manifiesto con un procedimiento de la PDI que permitió la incautación de pasta base y marihuana en pequeñas cantidades que estaba oculta en su domicilio.
Por estos hechos, la Fiscalía acusó al imputado y logró que fuera condenado en su calidad de autor del delito de tráfico de pequeñas cantidades de droga, siendo sentenciado a cumplir la pena efectiva de cárcel de tres años y un día además del pago de una multa de una Unidad Tributaria Mensual. Ordenando el Tribunal el ingreso del imputado a la cárcel de la capital regional para cumplir la pena impuesta.
