Defensor Regional de Atacama informa de Sistema de Registro, Comunicación y Atención Integral a víctimas de violencia institucional

Con la presencia de todos los defensores y defensoras de la región, a través de la plataforma cisco webex, el defensor regional, Raúl Palma Olivares dio a conocer el Sistema de Registro, Comunicación y Atención Integral a Víctimas de Violencia institucional Carcelaria (SIRCAIVI), cuyo objetivo es fortalecer el acceso a la justicia de las personas privadas de libertad, que hayan sufrido agresiones, apremios ilegítimos, vulneraciones o tortura, por parte de los agentes del Estado que los custodian.

“Este nuevo sistema implica un cambio cultural necesario para el sistema de justicia penal y un fortalecimiento urgente de los DD.HH. en el ámbito penitenciario, porque como sabemos la cárcel es controlada por el Estado, pero la rige la ley del más fuerte y esas violencias son inadmisibles en un estado de Derecho”, señaló el Defensor Regional.

Además, agregó que “se trata de una defensa más integral, que va a requerir mucha convicción profesional y colaboración interinstitucional, ya que se busca enfrentar lo que hasta el momento había sido invisibilizado y más aún normalizado que es la violencia contra las personas privadas de libertad. Como defensores debemos entregar dignidad a las personas privadas de libertad, acompañándolas y atendiéndolas en las situaciones en que son víctimas del Estado incluso por las condiciones materiales de los recintos penitenciarios”.

DEFINICIÓN DEL MODELO

Este sistema de registro fue desarrollado por el programa de la Unión Europea para la Cohesión Social, EUROsociAL+, y ejecutado en Chile por la Defensoría Penal Pública, a partir de un profundo diagnóstico latinoamericano y frente a la evidencia de altas tasas de sobrepoblación, hacinamiento y cruda violencia en las cárceles de nuestro país.

“La principal finalidad de este modelo es brindar, a las personas privadas de libertad víctimas de violencia institucional carcelaria, a través de defensores penales públicos, un acceso a la justicia, una atención y acompañamiento interdisciplinario y una prevención concreta de la tortura, tratos degradantes y violencias que sufren las personas al interior de la cárcel y así reforzar la misión de la Defensoria por el respeto de los DD.HH. de los grupos vulnerados de la sociedad”, explicó Palma Olivares.

Cabe destacar que el enfoque en la prevención integral de la violencia institucional y su abordaje debe ser un propósito mancomunado, por lo que en la inauguración del SIRCAIVI, en mayo pasado, se firmó un convenio para la creación de la “Mesa de diálogo y actuación intersectorial” (MEDAI), donde están presentes el Poder Judicial, la Fiscalía, el Servicio Médico Legal, el Instituto Nacional de Derechos Humanos y Gendarmería.

Al finalizar el encuentro, la defensora penitenciaria, Viviana Luco Amigo relató situaciones de violencia que le ha tocado atender y asesorar, “creo que este sistema es un gran paso para que este tipo de situaciones no vuelvan a ocurrir”.
