La Corte de Apelaciones de Copiapó confirmó la sentencia de primera instancia, que condenó en procedimiento abreviado a Wilmer Paul Colque Yujra a penas efectivas que suman 1.423 días, por los delitos reiterados de lesiones menos graves en contexto de violencia intrafamiliar, desacato, amenazas en contexto de violencia intrafamiliar y daños simples en contexto de violencia intrafamiliar. “Atendido el mérito de los antecedentes, registro de audio y lo expuesto por los intervinientes en la audiencia y de conformidad con lo dispuesto en los artículo 358, 360, 370 letra b) del Código Procesal Penal y artículo 37 de la Ley 18.216, SE CONFIRMA en lo apelado la sentencia de cuatro de mayo del año en curso, pronunciada por el Juez de Garantía de Copiapó, don Paulo Muñoz Pedemonte, en cuanto no sustituyó al sentenciado Wilmer Paul Colque Yujra, la pena impuesta en el fallo antes citado, por estimar que no se reúnen las exigencias contenidas en el artículo 15 y siguiente de la Ley 20.603, al no abordar el informe acompañado los elementos que exige el texto legal antes citado”, establece el fallo.
El fallo de primera instancia condenó a Colque Yujra a la pena de 300 días de presidio como autor del delito reiterado de lesiones menos graves en contexto de violencia intrafamiliar; la pena de 541 días de presidio por el delito reiterado de desacato; la pena de 541 días de presidio como autor del delito reiterado de amenazas en contexto de violencia intrafamiliar, y a la pena de 41 días de presidio, como autor del delito de daños simples en contexto de violencia intrafamiliar.
