Corte declaró «inadmisible» amparo de 29 militares de Punta Peuco que buscaban cumplir pena en casa
La Corte de Apelaciones de Santiago declaró “inadmisible” el recurso de amparo presentado por 29 militares (r) condenados por violaciones de derechos humanos que -en el contexto del coronavirus- buscaban cumplir sus penas con arresto domiciliario.
La resolución dictada por los ministros Dobra Lusic, Alejandro Rivera y el suplente Rafael Araneda, tiene 457 caracteres, donde establecieron que no hay derechos constitucionales conculcados.
“Que los antecedentes expuestos en el recurso no dan cuenta de hechos que, según el artículo 21 de la Constitución Política de la República, correspondan a aquellos susceptibles de la cautela impetrada por esta vía, puesto que se refieren a políticas públicas impulsadas desde la Presidencia de la República; por lo cual la acción de amparo deducida no puede ser acogida a tramitación. Por estas consideraciones, se declara inadmisible el recurso deducido”, se lee en el fallo.
La presentación ingresó al Poder Judicial el pasado 1 de abril, interpuesta por Alfred Cooper, obispo de la Iglesia Anglicana, Fernando Montes, sacerdote jesuita, el asistente pastoral Fernando Escudero; el pastor adventista Ricardo Pereira, directivo de la iglesia cristiana y el médico neurólogo Jorge Flefel, en su calidad de perito.
El libelo recurrió en contra del Presidente Sebastián Piñera, el ministro de Justicia Hernán Larraín, el subsecretario de la cartera Sebastián Valenzuela y el director de Gendarmería Christian Alveal.
