Corte de Copiapó ordena a sindicato abstenerse de bloquear caminos públicos y privados de acceso a faena minera

La Corte de Apelaciones de Copiapó acogió ayer –miércoles 21 de octubre- recurso de protección y ordenó al Sindicato de Trabajadores de la Compañía Minera Candelaria “Mina” cesar los bloqueos a los accesos a la faena de esa minera y abstenerse, en el futuro, de acciones que impidan la libre circulación por caminos públicos y privados de acceso a la minera, en la comuna de Tierra Amarilla. Todo lo anterior en el contexto de una huelga legal.

En fallo unánime (causa rol 402-2020), la Primera Sala del tribunal de alzada –integrada por el ministro Antonio Ulloa, el fiscal judicial Carlos Meneses y la abogada (i) Verónica Álvarez- dio lugar a la acción cautelar deducida, al constatar el actuar ilegal y arbitrario de la recurrida.

“(…) más allá del derecho a huelga que les reconoce el derecho laboral, lo cierto es que el bloqueo de los caminos se encuentra al margen de tal derecho y en la especie, claramente se trata de una acción cuya única finalidad es impedir que la actora pueda ejercer las labores propias de su giro y que constituyen una actividad económica amparada en nuestro ordenamiento jurídico”, establece el fallo.

La resolución que añade: “La conducta de los recurrida importa una afectación al derecho consagrado en el artículo 19 N° 21 de la Carta Fundamental, esto es, el derecho a desarrollar cualquiera actividad económica lícita, desde que la recurrente tiene el derecho a explotar las pertenencias mineras de su propiedad, existiendo como único límite la afectación de la moral, buenas costumbres y seguridad nacional”.

“No obstante ello –continúa- como consecuencia de los actos ilegales y arbitrarios de la recurrida y sus asociados, la empresa se ha visto imposibilitada de ejecutar íntegramente su actividad económica, ya que Minera Candelaria, como cualquier otra sociedad, requiere contar con el acceso libre y seguro a los bienes de su propiedad, a través de los caminos y rutas que están siendo obstaculizados, violentando además el derecho de propiedad protegido en el artículo 19 N° 24 de la citada Constitución Política, ya que mal puede decirse que ejerce en plenitud las facultades de usar, gozar y disponer libremente del bien propio”.

Por tal motivo, “esta judicatura se encuentra en la obligación de reestablecer el imperio del derecho, fundamentalmente por haberse omitido por parte de la recurrida el paso por la jurisdicción, al disponer por sí mismos mediante actos materiales el bloqueo selectivo de los caminos, determinando por sí y ante sí quien tiene derecho a su uso, lo que configura un acto de autotutela ilícita que impide el ejercicio de una actividad económica y no respeta los medios que el ordenamiento jurídico pone a su disposición para obtener la sanción de las eventuales prácticas desleales y/o anti sindicales, conducta incompatible con un Estado democrático de Derecho”.

Por tanto –concluye- “SE ACOGE, con costas, el recurso de protección deducido en lo principal del folio 1 por el abogado don Juan Carlos Pino Escobar, en representación de COMPAÑÍA CONTRACTUAL MINERA CANDELARIA, en contra del Sindicato de Trabajadores de Compañía Contractual Minera Candelaria “Mina”, representado por don Patricio Garate Flores, debiendo:

1°) Cesar todo acto material que altere o perturbe la libre circulación por los caminos públicos y privados de acceso a la faena de la recurrente, así como concluir los actos de bloqueo reclamados por la recurrente, en especial en el punto que conecta la Ruta C-397 con dichos caminos privados, y

2°) En lo sucesivo abstenerse de realizar cualquier acto material que altere o perturbe la libre circulación por los caminos públicos y privados de acceso a la faena de la recurrente, inhibiéndose de realizar actos de bloqueo, en especial en el punto que conecta la Ruta C-397 con dichos caminos privados”.
