Corte de Copiapó confirma condena de 7 años de presidio por abuso sexual de menor de edad en caldera
La Corte de Apelaciones de Copiapó rechazó el recurso de nulidad interpuesto por la defensa, en contra de la sentencia que condenó a M.P.R.M. a la pena efectiva de 7 años de presidio, en calidad de autor del delito consumado y reiterado de abuso sexual de menor de 14 años de edad, ilícito perpetrado en la comuna de Caldera, entre 2010 y 2012.
En fallo unánime, la Primera Sala del tribunal de alzada –integrada por los ministros Aída Osses Herrera, Rodrigo Cid Mora y el abogado (i) Óscar Iriarte Ávalos– desestimó que la sentencia recurrida, pronunciada por el Tribunal de Juicio Oral en lo Penal de Copiapó, se haya dictado con infracción de ley.
Para el tribunal de azada, “(…) si bien en el caso en análisis concurre a favor del condenado la circunstancia atenuante de responsabilidad de conducta anterior irreprochable, del artículo 11 N° 6 del Código Penal, los elementos que la configuran no sirven para considerar dicha minorante como muy calificada, en los términos que lo permite el artículo 68 bis del mismo cuerpo legal, concordando en todas sus partes con el razonamiento de voto de mayoría de la sentencia recurrida por vía de nulidad, para negar tal calificación a la referida atenuante”.
El fallo añade que “(…) conforme a la causal de nulidad invocada, corresponde dilucidar si en la sentencia se ha infringido lo previsto en los artículos 11 N° 6° y 68 bis del Código Penal, lo que en concepto de esta Corte no ha ocurrido, atendido lo expuesto en el Considerando que antecede, como asimismo por estimar que las fundamentaciones y conclusiones que formulan los sentenciadores a quo llevan a determinar que el fallo recurrido contiene el razonamiento lo suficientemente claro, fundado y concordante para no acoger la petición de la defensa en orden a dar el carácter de muy calificada a la circunstancia atenuante de responsabilidad invocada como tal por su parte, siendo la decisión de ello la deducción lógica de lo valorado previamente por los sentenciadores (…)”.
Para la corte copiapina, en la especie, “(…) conforme a lo expuesto, no cabe sino desechar el recurso de nulidad formalizado por el motivo que establece el artículo 373, letra b) del Código Procesal Penal, por no haberse incurrido en la causal de nulidad invocada, toda vez que no se ha hecho una aplicación errónea de la ley penal por parte de los sentenciadores, que haya influido de manera substancial en lo dispositivo de la sentencia recurrida”.
“Que, por último debe tenerse presente que el recurso de nulidad es un medio de impugnación de derecho estricto, estando determinadas las causales por las cuales procede en los artículos 373 y 374 del Código Procesal Penal, de tal manera que el legislador impone exigencias que deben ser cumplidas por la parte recurrente, sin dejar de considerarse que se está atacando la validez de un fallo y no lo que el recurrente pueda estimar como su justicia, por lo cual para su interposición no se trata solamente que la sentencia dictada por el tribunal a quo no sea del agrado o cause agravio a quien recurre, sino que en su pronunciamiento deben haberse obviado o vulnerado los requisitos o exigencias que la ley impone, de tal suerte que al no verificarse dicha infracción de ley, el recurso de autos no puede prosperar”, concluye.
