Corte de Apelaciones de Santiago dobla monto de indemnización a víctima de torturas en Chañaral
La Corte de Apelaciones de Santiago elevó a $40.000.000 (cuarenta millones de pesos) la indemnización que el fisco debe pagar a Pedro Julio Briones Contreras, quien fue detenido en su domicilio el 20 de noviembre de 1973 y trasladado a la capitanía de puerto de Chañaral, donde fue sometido a sesiones de tortura hasta 24 de diciembre de 1973, día que recuperó la libertad.
En fallo unánime (causa rol 8.226-2020), la Segunda Sala del tribunal de alzada –integrada por las ministras Maritza Villadangos, Paula Rodríguez y la abogada (i) Pía Tavolari– consideró que el doble de la indemnización fijada por el 11° Juzgado Civil de Santiago, por concepto de daño moral, se condicen más con el padecimiento sufrido por el demandante.
“Que en cuanto al pretium doloris del daño extrapatrimonial demandado, esta Corte lo avaluará prudencialmente, teniendo en consideración para ello, la edad del demandante a la época en que fue detenido y torturado por agentes del Estado; las circunstancias que rodearon este hecho; la duración y gravedad de los padecimientos físicos y emocionales sufridos; y especialmente los montos judicialmente asignados a víctimas de violaciones a los derechos humanos en causas similares, en la suma de cuarenta millones de pesos”, razona el tribunal.
“Que en lo que atañe al pago de las costas de la causa, cabe reflexionar que conforme dispone el artículo 144 del Código de Procedimiento Civil, puede eximirse de su pago a la parte que ha litigado con motivo plausible, circunstancia que se aprecia en este caso, respecto del Fisco de Chile, atendida la naturaleza de la acción deducida en su contra”, añade.
Por tanto, se I.- Que se revoca la sentencia apelada de fecha dos de abril de dos mil veinte, dictada por el 11° Juzgado Civil de Santiago, en los autos rol N°14.733-2019, sólo en cuanto condenó en costas al demandado Fisco de Chile; y en su lugar se dispone que se le exime de dicha carga. II.- Que se confirma en lo demás apelado el aludido fallo, con declaración que la suma que se condena pagar a la parte demandada a título de daño moral es la de cuarenta millones de pesos ($40.000.000), más reajustes conforme al alza del Índice de Precios al Consumidor que se devenguen a contar de la fecha en que esta sentencia quede ejecutoriada y hasta la de su pago efectivo y que dicha suma así reajustada devengará además intereses corrientes para operaciones reajustables los que se contabilizarán desde que el deudor sea constituido en mora”.
