Corte de Apelaciones de Copiapó ordena reintegrar a socios de comunidad indígena de Diego de Almagro

La Corte de Apelaciones de Copiapó acogió el recurso de protección interpuesto en contra del presidente de comunidad indígena Colla Geoxcultuxial, del sector rural de la comuna de Diego de Almagro, por la expulsión de un grupo de miembros de agrupación.

En fallo unánime la Primera Sala del tribunal de alzada –integrada por los ministros Pablo Krumm, Antonio Ulloa y el abogado (i) Óscar Iriarte– acogió la acción deducida, tras constatar el actuar ilegal y arbitrario de la recurrida, al constituirse la asamblea general de la comunidad como comisión especial.

“Que a este respecto, hay que señalar que en el ámbito de las organizaciones privadas también rige el principio del juez natural, en la medida que éstas también pueden juzgar y aplicar sanciones a sus integrantes, siempre que les hayan sido atribuidas por estos mismos facultades sancionadoras, en virtud del derecho de asociación, casos en los cuales deben estas organizaciones atenerse en el ejercicio de esas facultades, no a la ley general, sino que a sus propios estatutos en cuanto estos deben establecer un debido proceso, a cargo de un órgano determinado, el cual puede aplicar sólo las sanciones que el mismo ordenamiento interno establece, y asegurando a sus asociados, mediante un procedimiento previamente establecido, el derecho a defensa y a ser sancionados mediante resoluciones fundadas”, establece el fallo.

La resolución añade que “(…) efectuado el estudio de los Estatutos de la comunidad en comento, se desprende que si bien el artículo 22, letra b) otorga específicamente al Directorio la facultad para aplicar sanciones a sus miembros por incumplimiento de sus obligaciones, tal normativa no establece un catálogo de actos que merecen sanciones ni la naturaleza o entidad de éstas, como tampoco el procedimiento que debe observarse para su aplicación, sin perjuicio de establecer en su artículo 40, el arbitraje ante la Conadi para el caso de producirse algún conflicto entre los miembros del Directorio acerca de la interpretación de los estatutos y reglamentos o de conflictos entre los miembros de la comunidad acerca de los derechos, obligaciones y usufructo de los bienes comunes”.

“(…) de esta manera –continúa–, sólo queda concluir que al sancionar la Asamblea General de la Comunidad Indígena Colla Geoxcultuxial a los recurrente con la pérdida de sus calidades de socios de esa entidad, han actuado como una comisión especial, acto que es ilegal y arbitrario, y que ha quebrantado claramente derechos garantizados por la Constitución Política”.

Por tanto, se resuelve que: “SE ACOGE la acción de protección deducida en contra de don José Jesús Reinoso Marcial, en su calidad de Presidente del Directorio de la Comunidad Indígena Colla Geoxcultuxial y se declara que esta comunidad deberá reintegrar de inmediato a los recurrentes Oriana Teresa Marcial Jerónimo, doña Juana Herminda Jerónimo Jerónimo, doña María Margarita Marcial Jerónimo y don Rolando Iriarte Pizarro, todos en sus calidades de comuneros de la citada entidad, con todos sus derechos y obligaciones, debiendo abstenerse de continuar ejerciendo acciones dirigidas a privarlos de sus derechos como integrantes de la misma, con costas”.
