Corte de Apelaciones acoge recursos de nulidad a sentencia por parricidio y ordena realizar nuevo juicio en contra de imputados

Con fecha 5 de octubre del año 2021 la Corte de Apelaciones de Copiapó acogió dos recursos de nulidad presentados en contra de la sentencia que condenaba a dos imputados por el delito de parricidio en perjuicio de su pequeña hija, una lactante.

Según la resolución del reciente fallo del tribunal de alzada de la ciudad capital de la Región de Atacama, en su parte medular explica la inexistencia de pruebas convincentes que acrediten la autoría en el delito por parte de los padres, por lo que ordena efectuar un nuevo juicio en contra de ambos imputados.

“Por estas consideraciones y con lo dispuesto en los artículos 297, 342 letra c), 374 letra c) y e), 375 y 376 del Código Procesal Penal, SE ACOGEN los recursos de nulidad interpuestos por el abogado, Patricio Pinto Castro, Defensor Privado, en representación de la condenada de iniciales A. N. U. F. y de Elizabeth Poblete Astudillo, Defensora Privada, en representación del sentenciado de iniciales A. E. V., en relación a la causal subsidiaria invocada, esto es, la del artículo 374 letra e) del Código Procesal Penal, anulándose la sentencia definitiva dictada en la presente causa con fecha veintinueve de julio último, como asimismo, el juicio oral en que recae, debiendo remitirse los autos al tribunal no inhabilitado que corresponda, para la realización de una nueva audiencia de juicio oral”, subraya el fallo de la primera sala de la Corte de Apelaciones de Copiapó.

En otra parte central del libelo, se señala textualmente que: “que de todo lo anterior resulta que la sentencia recurrida no cumple las exigencias de las normas relacionadas en el considerando precedente y conforme a la interpretación que de ellas ha hecho esta Corte, en cuanto no satisface la rigurosidad procesal que ella misma se exige para “hacerse cargo en su fundamentación de toda la prueba producida, incluso de aquella que hubiese desestimado, indicando en tal caso las razones que hubiere tenido en cuenta para hacerlo”. El tribunal ha reconocido la prueba presentada por las defensas, pero la desestima, en razón de que la prueba presentada por los acusadores les ha resultado suficiente para adquirir una convicción condenatoria, lo cual constituye un análisis que a todas luces resulta insuficiente. Se trata del ejercicio que la doctrina denomina “motivación incompleta o deficiente”, situación en que no se exponen las razones de orden probatorio, ni los fundamentos jurídicos en los cuales los falladores sustentan su decisión, o los motivos aducidos son insuficientes para identificar las causas en que ella se sustenta”.

“Conforme a lo observado, resulta que en el fallo en examen se ha visto afectado el principio de razonabilidad o razón suficiente, al advertirse en el mismo una falta de fundamentación tendiente a explicar convincentemente el razonamiento que el sentenciador ha utilizado para concluir en el juicio de condena que se conoce, a partir de los diversos medios de prueba incorporados en la audiencia de juicio, más sin ejercer el control jurisdiccional y público a que está llamado respecto de la prueba desestimada, en los términos expuestos precedentemente. De este modo al no poder encontrar en la sentencia una explicación clara, lógica y completa en este ámbito, es evidente que en ella se ha visto afectada la razonabilidad del juicio empírico, haciéndole incurrir en la causal de nulidad prevista en el artículo 374 letra e), en relación con los artículos 342 letra c) y 297 del Código Procesal Penal, en cuanto exigible a todo proceso racional y justo, cuya omisión torna a aquella parcial e indefectiblemente nula, así como el juicio en que la misma aparece dictada”.
