Arriesgan Multas de U$8 Millones o Clausura: SMA formula cargos a Puerto Caldera S.A. y Serviport Ltda

*Se trata de infracciones graves por fraccionamiento de proyecto e incumplimiento de medidas provisionales pre-procedimentales dictadas por la Superintendencia del Medio Ambiente en febrero recién pasado.

La Superintendencia del Medio Ambiente (SMA) formuló cargos graves contra “Puerto Caldera S.A.” y “Servicios Portuarios del Pacífico Limitada (Serviport)”, titulares de los proyectos “Acopio y Embarque de Concentrado de Cobre en Muelle Punta Caleta de Puerto Caldera S.A.” y “Acopio en Cancha de Mineral de Hierro Proveniente de Terceros” por fraccionar un único proyecto que contempla, a lo menos, el acopio, transporte y embarque de hierro, y el acopio y embarque de concentrado de cobre, eludiendo así el ingreso al Sistema de Evaluación de Impacto Ambiental (SEIA) y evitando la correcta evaluación ambiental. 

Al respecto, el Superintendente del Medio Ambiente, Cristóbal De La Maza, señaló que “es importante recordar que en diciembre de 2020 y en visita oficial a la Región de Atacama -comuna de Caldera-, nos reunimos con los vecinos de los proyectos que fueron sancionados, y les manifestamos que haríamos una investigación acuciosa de los hechos denunciados por ellos. En este sentido, hemos trabajado responsablemente como Superintendencia y tras analizar todos los antecedentes expuestos, pudimos determinar que estos hechos constituyen infracciones, y, por lo tanto, es nuestra obligación actuar con todas las herramientas que la ley dispone para enfrentar hechos como éstos”.

El cargo por Fraccionamiento del Proyecto se produce al haber separado las actividades de acopio y embarque de concentrado de cobre; acopio, transporte y embarque de hierro, por parte de Puerto Caldera S.A. y SERVIPORT, sociedades relacionadas, generándose emisiones atmosféricas. Por lo tanto, se trata de hechos, actos u omisiones que constituyen infracciones conforme al artículo 35, letra b) de la LOSMA, en cuanto a ejecución de proyectos y desarrollo de actividades para las cuales la normativa exige Resolución de Calificación Ambiental.

La segunda infracción formulada, corresponde al Incumplimiento de la Medida Provisional Pre-Procedimental decretada por la SMA en febrero de 2021, con la finalidad que el titular realizara una serie de acciones para disminuir y atenuar el riesgo ambiental detectado en relación a las emisiones atmosféricas no controladas generadas por el desarrollo del proyecto “Acopio en Cancha de Mineral de Hierro Proveniente de Terceros”. Estos hechos, actos u omisiones constituyen infracciones conforme al artículo 35, letra l) de la LOSMA, por no cumplir las obligaciones derivadas de las medidas provisionales previstas en el artículo 48 de la misma Ley.

Ambos cargos fueron clasificados como Graves, por lo que las empresas podrían ser objeto de una Multa de hasta 10.000 Unidades Tributarias Mensuales (UTA), Revocación de su Resolución de Calificación Ambiental (RCA) o Clausura del Proyecto.
