Imputado por femicidio frustrado fue sentenciado a cumplir 7 años de presidio efectivo
La Fiscalía de Atacama argumentó en audiencia de Juicio Oral los antecedentes de una investigación que dirigió por un delito de femicidio frustrado, instancia judicial en que obtuvo la condena del acusado de quien se acreditó su participación en el ilícito.
Los hechos materia de investigación de este caso fueron argumentados en audiencia de Juicio Oral por el fiscal adjunto de Copiapó, Guillermo Zárate Chacana, quien en los alegatos de apertura indicó que el acusado atacó a su pareja, con quien tiene un hijo en común, con un arma blanca en el domicilio que ocupaban en el sector de tomas de la población Juan Pablo II de esta ciudad. Grave hecho de violencia de género que ocurrió en el mes de octubre del año pasado y que fue presenciado además por la madre de la víctima, quien intervino en la agresión en defensa de su hija, luego de lo cual el agresor se dio a la fuga.
“En el desarrollo de este Juicio la Fiscalía de Atacama presentó distintos medios de prueba que permitieron acreditar la actuación del acusado, teniendo en ellos evidencia testimonial y pericial reunida en el desarrollo de la investigación”, dijo el fiscal.
En el desarrollo del Juicio Oral Guillermo Zárate, además, entregó como antecedente los informes médicos que establecieron que la víctima sufrió lesiones de gravedad a raíz del ataque con un cuchillo en su espalda, las que de no mediar la oportuna intervención médica hubieran ocasionado un desenlace fatal en la mujer.
Los hechos antes mencionados fueron calificados por la Fiscalía como un delito de femicidio en grado de frustrado, cabiéndole al acusado participación directa en el delito. De esta manera, los Jueces del mencionado Tribunal determinaron condenarlo de manera unánime a partir de los antecedentes expuestos por el fiscal Zárate y aplicar una pena de 7 años y 183 días de presidio. Sanción que no fue objeto de beneficios alternativos, por lo que deberá ser cumplida de manera efectiva en la cárcel.
