En fallos unánimes la Corte de Apelaciones de Copiapó dicta orden de no innovar y suspende proceso de licitación del litio
La Corte de Apelaciones de Copiapó dio por interpuestos hoy –viernes 14 de enero– sendos recursos de protección, dictó orden de no innovar y dispuso la inmediata suspensión del proceso de selección y adjudicación del proceso de licitación pública nacional e internacional para la exploración y explotación de yacimientos de litio.
En fallos unánimes (causas roles 9-2022 y 10-2022), la Primera Sala del tribunal de alzada –integrada por la ministra Marcela Araya Novoa, el fiscal judicial Carlos Meneses Coloma y la abogada (i) Verónica Álvarez Muñoz– acogió las solicitudes del gobernador regional de Atacama y de comunidades indígenas, respectivamente, y dio un plazo de de 10 días para que la parte recurrida evacue un informe sobre la materia.
“Téngase por interpuesto recurso de protección. Pídase informe a los recurridos (ministro de Minería y subsecretario de minería), el que deberá evacuarse dentro de décimo día, debiendo acompañar todos los antecedentes que obren en su poder”, ordena la corte copiapina.
“Ofíciese a efectos de notificar a la recurrida por la vía más expedita de la interposición del presente recurso y la concesión de orden de no innovar, adjuntando copia del recurso y de la presente resolución”, añade.
