La Corte de Apelaciones de Copiapó rechazó el recurso de nulidad interpuesto por la defensa en contra de la sentencia que condenó a E.E.T.H. a las penas efectivas de 10 años y 5 años y un día de presidio, en calidad de autor de los delitos consumados de violación y abuso sexual de menor de 14 años, respectivamente. Ilícitos perpetrados en la comuna de Huasco, entre 2010 y 2014.

En fallo unánime, la Primera Sala del tribunal de alzada –integrada por los ministros Marcela Araya Novoa, Juan Antonio Poblete Méndez y Rodrigo Cid Mora– desestimó que la sentencia recurrida, pronunciada por el Tribunal de Juicio Oral en lo Penal de Copiapó, se haya dictado con infracción legal.

“(…) lo que el recurrente efectúa en su libelo impugnatorio es diseccionar la prueba de cargo, y relevar descontextualizadamente pasajes o afirmaciones en apoyo de su tesis absolutoria, pero obviando que, aquello en que pone el acento, está suficientemente explicado en el fallo del tribunal de mérito”, afirma el fallo.

La resolución agrega que: “Olvida el recurrente que no solo existen los elementos de juicio que aisladamente valora, sino que toda prueba, después de ser objeto de un análisis de credibilidad o atendibilidad que implica valorarla individualmente; debe ser materia de la valoración conjunta, y es precisamente esta valoración que permite que los elementos de juicio corroboren o refuten las diversas hipótesis, las que deben ser analizadas de manera entrecruzada”.

Para el tribunal de alzada: “(…) la alusión a la lógica debe ser entendida, como lo hace la doctrina más autorizada sobre el tema (Ferrer,2007, pp. 120 y ss. y Accatino, 2010, p. 126), al método de contrastación de hipótesis o de la inferencia inductiva, el que se despliega normalmente a través de inferencias probatoria empíricas, sirve para expresar la relación lógica de corroboración o confirmación entre un elemento de juicio y la hipótesis acerca de la ocurrencia de un hecho principal o de un hecho secundario que, a través de una nueva inferencia, otorgará apoyo inductivo, a su vez, a un hecho principal y este razonamiento o cadena de razonamientos deben expresarse de manera objetiva o, al menos, intersubjetiva en la sentencia”.

“Entonces –prosigue– al tiempo de invocar la causal concernida es obligatorio para el recurrente señalar con precisión la forma en que se habría obviado las inferencias que permiten recorrer el iter de los elementos de juicio a las conclusiones sobre los hechos probados o de qué manera se recurrió a una máxima de experiencia espuria o sin sustento epistémico o cómo se ha subvertido el conocimiento experto, lo que además de no ser advertible en la sentencia que se revisa no ha sido señalado por el recurrente, quien se ha limitado tanto en el texto del libelo invalidatorio como en los alegatos que ha formulado en la vista del recurso a discordar de cómo fue valorada la prueba, realizando una nueva ponderación de la misma de manera puntual y descontextualizada”.

Por tanto, se resuelve que: “SE RECHAZA el recurso de nulidad interpuesto por el defensor penal privado don Pablo Ehremberg Osorio en contra de la sentencia de fecha treinta y uno de enero de dos mil veintidós, pronunciada por la Primera Sala del Tribunal Oral en lo Penal de Copiapó, sentencia que, consecuentemente, NO ES NULA”.
