Condenados autores de robo a local comercial y cumplirán 5 años de presidio

La Fiscalía de Atacama consiguió acreditar en audiencia de Juicio Oral la participación consumada de dos acusados en un delito de robo que afectó a un local comercial ubicado en el sector de la Hacienda San Pedro en Copiapó.

LOS HECHOS:

De acuerdo a la acusación presentada por el fiscal que dirigió las diligencias investigativas, Sebastián Coya González, los hechos ocurrieron el 24 de julio del año pasado alrededor de las 20 horas, cuando los acusados, José Santiago Maya y Brian Saavedra Verasay, junto a otros sujetos, llegaron a bordo de una camioneta hasta el mencionado sector, ocasión en que portando armas de apariencia de fuego y cortopunzantes intimidaron al dueño del recinto comercial. Acción que logró ser advertida por funcionarios de la PDI que se encontraban en las inmediaciones, cuestión que motivó la huida de los participantes de la comisión de este delito. Concretándose luego la detención de ambos acusados.

EL JUICIO:

En el juicio, la Fiscalía presentó prueba diversa que dio cuenta de la participación en grado de consumada de los dos imputados, dentro de los cuales se contó con un video de las cámaras de seguridad en que se pudieron advertir los hechos, además de presentar el Ministerio Público testimonios de la víctima, testigos y los funcionarios policiales que tomaron parte en el procedimiento. De esta manera se pudo establecer que Saavedra Verasay tuvo la tarea de conducir el vehículo hasta el lugar, facilitando con ella la comisión del robo. Mientras que Santiago Maya fue uno de los participantes que intimidó a la víctima.  

De esta forma, la Fiscalía obtuvo la condena de ambos acusados por su responsabilidad en el delito de robo con intimidación, quienes deberán cumplir cada uno de ellos la pena de 5 años y un día de presidio, sanción a la que no se otorgaron beneficios alternativos motivo por lo que la sentencia tendrá ser cumplida de manera efectiva en la cárcel de Copiapó.
