Sentencia será conocida mañana en audiencia a las 21 horas: Fiscalía acredita delito de apremios ilegítimos y logra condena en contra de dos ex carabineros
La Fiscalía de Atacama, mediante una audiencia de Juicio Oral, obtuvo un veredicto condenatorio en contra de dos ex funcionarios de Carabineros a quienes se indagó luego de una denuncia de agresión que afectó a un detenido.
Los hechos contenidos en esta causa fueron investigados por el fiscal adjunto de Copiapó, Luis Miranda Flores, quien luego de la recolección de los antecedentes y medios de prueba respectivos, presentó el caso ante el Tribunal de Juicio Oral de la capital regional juicio que se extendió por más de una semana.
De acuerdo a éstos, el día 5 de mayo del mencionado año, alrededor de las 17 horas, los imputados, Bryan Cortés Celedón y Juan Mora Daigre, ambos de grado cabo segundo, aprehendieron a la víctima, un hombre adulto que mantenía una orden vigente de detención por su participación en un delito de daños simples.
En el juicio se conoció, a partir de la evidencia y testimonios reunidos, que los imputados agredieron físicamente al detenido con el objetivo que entregara información respecto a su identificación. Determinándose que a los golpes de puño, siguieron agresiones con un bastón de uso policial. “Según los antecedentes reunidos, debido a esos golpes la víctima cayó al suelo, sufriendo un traumatismo con rotura de bazo, sangrado y hemiperitoneo secundario de carácter grave con riesgo vital, según el diagnóstico médico”, dijo el fiscal. Agregando que el herido debió ser atendido de urgencia en el Hospital Regional.
En la audiencia la Fiscalía acreditó que luego de la agresión consumada en la vía pública, el afectado fue trasladado hasta la subcomisaría Pedro León Gallo de la institución, lugar en que nuevamente fue golpeado por los imputados con patadas en el cuerpo y a mano abierta en la cara.
En el juicio el fiscal Luis Miranda presentó distintos documentos y peritajes, material probatorio que avalaron los hechos contenidos en la acusación respecto de la actuación de ambos ex funcionario policiales.
Frente a ello, los acusados fueron declarados, de forma unánime, culpables en su calidad de autores del delito de apremios ilegítimos en contra de la víctima, quien debido a su condición de vida en situación de calle no se presentó a declarar en el juicio.
La sentencia a la que serán sancionados ambos acusados será dada a conocer en una audiencia que fue fijada por la Primera Sala del Tribunal Oral para este domingo a las 21 horas.
