*Los hechos sometidos a la indagatoria ocurrieron en el mes de diciembre del año 2016, luego de un control carretero en que se incautó un arma de fuego y dinero en moneda extranjera.

Tras una investigación desarrollada por la Fiscalía Local de Chañaral, en cuyas diligencias trabajó con personal de la Brigada de Delitos Económicos de la PDI, se obtuvo la condena de cinco imputados, quienes fueron acusados del delito de malversación de caudales públicos.

ANTECEDENTES:

Los antecedentes indagados y que fueron acreditados en audiencia de Juicio Oral por el fiscal Marcelo Torres Rossel, dan cuenta que el 15 de diciembre del año 2016 cuando los condenados,- en ese tiempo funcionarios de Carabineros de la Primera Comisaría de Chañaral,- Miguel López Villagrán, Víctor Hernández Reyes e Iván Vázquez Jara, adoptaron un procedimiento de control carretero y procedieron a controlar un vehículo en que circulaban dos personas.

“En este trabajo de fiscalización uno de los funcionarios se percató que en el asiento trasero del vehículo había una mochila y en ella se advertía la empuñadura de un arma de fuego, cuestión que motivó la detención de los ocupantes del móvil. Luego de ello, concurrieron al lugar otros dos funcionarios policiales para apoyar la tarea de fiscalización”, indicó el fiscal Torres.

En la audiencia se argumentó que hasta el sector del procedimiento arribaron Alejandro Castillo Castillo y Oscar Jorquera Gaete, los que, junto a los otros acusados, realizaron la revisión del auto y el equipaje, ocasión en que el imputado López Villagrán encontró e incautó, además del arma de fuego, la cantidad de 21 mil dólares, dinero del cual todos los funcionarios presentes en el procedimiento tuvieron conocimiento de su hallazgo.

“La investigación llevada a cabo posterior a este hecho junto a la Bridec pudo establecer que los acusados consintieron en dejar constancia en el parte policial y el acta respectiva, únicamente de la incautación de 11 mil dólares. Cifra que fue remitida bajo cadena de custodia a la Fiscalía Local de Chañaral”, dijo el fiscal.

De acuerdo a la investigación, los imputados repartieron el dinero restante entre todos quienes participaron de esta fiscalización, lo que se concretó con distintos montos, pudiéndose establecer además que dos de ellos cambiaron su parte del dinero en casos de cambio de Copiapó y Santiago días posteriores a la comisión del delito.

Respecto de esta investigación, el comisario de la Bridec de la PDI, Danilo Quiroga, indicó que  «se desarrolló un exhaustivo proceso investigativo, que involucró una serie de indagaciones, declaraciones y obtención de documentos que permitieron al equipo investigador entregar los insumos necesarios a la Fiscalía Local de Chañaral, para obtener las condenas conocidas para estos ex empleados públicos, quienes aprovechándose de esa condición sustrajeron una importante suma de dinero correspondiente a un procedimiento efectuado en diciembre de 2016 en la comuna de Chañaral».

JUICIO ORAL:

En la audiencia de Juicio Oral por este caso la Fiscalía acusó por el delito consumado de malversación de caudales públicos a todos los involucrados, presentando distinta prueba documental y testimonial, entre ellas la declaración de los funcionarios de la PDI que realizaron las diligencias investigativas de este caso.

Con ello, los Jueces condenaron de manera unánime a todos los acusados por su participación consumada en el ilícito indagado.

De esta manera, la mañana de ayer lunes se conoció que los condenados Jorquera Gaete y Hernández Reyes fueron sentenciados a penas efectivas de cárcel de 5 años y un día; en tanto López Villagrán fue sentenciado a 5 años de presidio, mientras que Vásquez Jara y Castillo Castillo cumplirán tres años y un día. Los tres últimos bajo el régimen de libertad vigilada intensiva.
