Juzgado de Garantía de Vallenar acogió recurso de amparo para que mujer de 78 años cumpla pena en su domicilio
La defensora penitenciaria de Atacama, Viviana Luco Amigo, logró que se modificara la pena efectiva de una mujer de 78 años privada de libertad en el centro de detención preventiva de la misma comuna, por la de arresto domiciliario total, tras acogerse el recurso de amparo presentado en el Juzgado de Garantía de Vallenar.
La adulta mayor se encontraba privada de libertad desde junio de 2021 y en las últimas semanas presentó antecedentes de enfermedades de carácter crónico y psiquiátricos, “ella tuvo etapas de crisis, pues la trasladaron en varias oportunidades al CESFAM, por su delicado estado de salud”, señaló la Defensora.
Al respecto agregó que “logramos que se acogiera nuestra petición, ya que presentamos antecedentes sobre la salud de la señora y su riesgo de contraer Covid 19, además de su situación familiar. Su hija se haría cargo de ella, en caso de sustitución de pena. Como fundamento, utilicé también la ley de indulto conmutativo, ya que si hubiese sido condenada cuando se dictó la norma, ella hubiese sido beneficiada. También el decreto 518, que regula los establecimientos penitenciarios”.
El defensor regional de Atacama, Raúl Palma Olivares indicó que “es sumamente importante este caso, puesto que se trata de personas privadas de libertad con enfoque diferenciado: vejez, género, enfermedad, entre otros, que requieren una mirada especial, donde la cárcel material resulta mucho más gravosa y aflictiva que para otra persona, dada su especial situación de vulnerabilidad. De hecho, estamos ad portas de una Opinión Consultiva de la Comisión Interamericana, sobre este punto específico de gran relevancia”.
Dentro de los argumentos utilizados por la defensa de la mujer, se encuentran diversos tratados internacionales, como la declaración Universal de Derechos Humanos, la Convención contra la tortura y otros tratos crueles e inhumanos o degradantes, el Pacto Internacional de los Derechos Civiles y Políticos y la Convención para la eliminación de todas las formas de discriminación contra la mujer, adoptada por la asamblea General de Naciones Unidas.
“El reto regional en materia de defensa penal es que los defensores y defensoras, logren avizorar estas situaciones tempranamente, incorporando estándares de DIDH activamente en las alegaciones y defensas estratégicas, saliendo del círculo penal puro y duro, es decir, del ámbito formal del derecho, ya prácticamente sobrepasado por la realidad”, agregó el Defensor Regional.
La Defensora señaló que fue “un caso difícil, porque nuestra legislación no comprende ninguna norma que nos permita sustituir la pena, sin embargo, la norma internacional referente a los DD.HH. nos permitió hacerlo. Es importante aterrizar la norma al contexto que estamos viviendo, generar empatía con la convicción de que el Juez nos debe escuchar, las penas privativas de libertad no pueden causar más dolor de lo que causan”.
Además, destacó el trabajo interinstitucional realizado, ya que su primera línea de acción fue comunicarse con el área técnica del CDP de Vallenar para solicitar ficha única de su representada, después con personal de Gendarmería de Chile, que ayudo bastante en el trabajo de recopilación de información.
Una vez obtenida la ficha única de la condenada más los antecedentes aportados por la hija de la adulta mayor, se presentó el amparo ante el Juzgado de Garantía de Vallenar, “quienes nos notificaron el mismo día que la audiencia se celebraría al día siguiente, donde se acogió nuestra petición, sustituyendo la pena efectiva de cárcel por la de arresto domiciliario total”, concluyó la Defensora Penitenciaria de Atacama.
