JVRH con autoridades regionales y comunidades de aguas, recurrió a la Corte Suprema por litigio con privados por aguas del estero Matancilla
* La senadora Yasna Provoste calificó de “equivocado y regresivo” el fallo de la Corte de Apelaciones que otorga derechos de agua por 920 litros por segundo del estero Matancilla a tres sociedades privadas. “Esperamos que la Corte Suprema haga justicia”, sentenció la parlamentaria por Atacama.
* La JVRH sostiene que “se generaron derechos anómalos pues nunca existió uso alguno de las aguas, son derechos de papel”.
La Junta de Vigilancia de la Cuenca del Río Huasco y sus Afluentes (JVRH), y comunidades de aguas de la provincia del Huasco, recurrieron hoy al máximo Tribunal Supremo, apoyados por la senadora Yasna Provoste, para revertir el fallo de la Corte de Apelaciones de Santiago que otorga derechos de aguas por 920 litros por segundo del estero Matancilla, caudal del río Huasco, a tres sociedades privadas, en desmedro de los habitantes de la provincia del Huasco, región de Atacama.
Los demandantes interpusieron recursos de casación en la forma y, conjuntamente de apelación, en contra de la sentencia de primera instancia del 3° Juzgado Civil de Santiago que le han dado un valor superlativo a las sentencias judiciales que de manera anómala ordenaron la inscripción y declararon perfeccionados los derechos de aprovechamiento de aguas de tres sociedades privadas; Juan Pablo Pasenti Rojas, empresario; Inversiones Catemu Limitada; e Inversiones Los Notros Limitada.
El máximo ejecutivo de la Junta de Vigilancia del Río Huasco, Nicolás del Río Noé, explicó que “hemos recurrido a la máximo Tribunal Supremo para revertir dicho fallo, porque nunca en 50 años la Junta de Vigilancia ha repartido aguas en ese sector pues nunca ha habido aprovechamiento alguno, hasta el día de hoy. Las aguas en conflicto nunca se han utilizado por quienes pretenden convalidar tales derechos de papel. El uso de las aguas es un requisito fundamental para generarse un derecho de aguas, según nuestra legislación vigente, por lo que constituye una insubsistencia de derechos de aprovechamiento de aguas”.Y agregó que “tales derechos fueron inscritos de una manera clandestina, con ocultamiento hacia quienes podrían haberse opuesto en el mismo, como es el caso de la JVRH y de todos los demás titulares de derechos de aprovechamiento legítimos en la cuenca del río Huasco”.
Asimismo, del Río expresó que “la solicitud para regularizar, inscribir y formalizar los derechos de aprovechamiento debió ser tramitada conforme a lo dispuesto por el artículo 2° transitorio del Código de Aguas; el cual contempla medidas de publicidad de la respectiva solicitud hacia los terceros que pudieran sentirse perjudicados por la misma, de manera tal que ningún titular de derechos de aprovechamiento legítimos en la cuenca del río, regantes, comunidades de aguas del Huasco, tuvo la oportunidad procesal para hacerse parte en los referidos procedimientos judiciales de perfeccionamiento, oponiéndose en los mismos y aportando los medios de prueba que estimaran pertinentes para acreditar sus oposiciones”. Por su parte, la senadora por Atacama, Yasna Provoste, calificó de equivocado y regresivo el fallo de la Corte de Apelaciones de Santiago del pasado 2 de febrero, que otorga derechos de agua por 920 litros por segundo del estero Matancilla, en la provincia del Huasco, a tres sociedades privadas, “dejando sin propiedades de agua a los habitantes del valle del Huasco, a los comités de Agua Potable Rural que accedían al vital elemento, así como también marginando a los pequeños regantes de sus derechos”.
Con este fallo, continuó Provoste, “volvemos a la época en que el destino era meramente especulativo, eso era lo que defendía el Código de la dictadura. Este fallo, además, promueve serios conflictos vinculados al agua, ya que no asegura el derecho humano al agua, a la protección de los ecosistemas, sino que solo ve la especulación de un elemento vital de una zona como la nuestra caracterizada por la escasez hídrica”.
Asimismo, la legisladora señaló estar a la espera de “que la Corte Suprema haga justicia, y reconozca además los derechos ancestrales de nuestras comunidades indígenas, de los comités de Agua Potable Rural de nuestra zona, de los pequeños agricultores y, efectivamente, coloque en la balanza de la justicia el derecho humano como lo constituye el agua para la subsistencia humana en nuestra zona”.
Miguel Vargas, Gobernador Regional de Atacama, enfatizó que como Gobierno Regional apoyarán todas las acciones que emprendan los regantes del valle de El Carmen para revertir el fallo de la Corte de Apelaciones: “La Junta de Vigilancia está recurriendo a la Corte de Suprema, acto que estamos apoyado porque de ratificarse este fallo podría significar derechamente la muerta del valle. Tenemos que defender con mucha fuerza el territorio, las actividades económicas, y todas aquellas actividades que dependan del vital elemento como la pequeña agricultura, los APR, por lo que solicitaremos a los abogados de la JVRH que pidan formalmente en la Suprema que la Dirección General de Aguas (DGA) se pronuncie, un organismo extremadamente importante en este tipo de materias, además sostendremos una reunión con el ministro de Obras Públicas y el director nacional de la DGA”.
Por otra parte, Juan Escobar, presidente de la comunidad de Agua Potable Rural (APR) de Alto del Carmen, lamentó el fallo de la Corte de Apelaciones señalando que “si otorgan derechos de aguas del Matancilla a privados nos vamos a quedar sin agua para el consumo humano, no solo en Alto del Carmen, también en Vallenar, Freirina y Huasco. El valle va a morir. Nosotros nos abastecemos del agua de las napas subterráneas que provienen del río Matancilla y subsistimos con esas aguas, con las cuales alimentamos a la población de Alto del Carmen y le damos vida al pueblo. Si se nos restringe el agua vamos a desaparecer, vamos a tener que emigrar. Todo esto es lamentable”.
En el mismo contexto, Escobar enfatizó que Alto del Carmen “contribuye con la producción de vinos artesanales, el pisco y el reconocido pajarete, además de la agricultura que se verá afectada producto de esta decisión”.
