5 años de presidio para autor del delito de abuso sexual que afectó a una menor
A partir del trabajo investigativo de la Fiscalía de Atacama una investigación por el delito de abuso sexual culminó con la condena del acusado, quien fue sentenciado a cumplir una pena efectiva de cárcel.
Según lo informado por el fiscal jefe de Vallenar, Nicolás Zolezzi Briones, los hechos sometidos a la investigación afectaron a una niña menor de edad, motivo por el que la investigación involucró las diligencias respectivas en este tipo de casos.
Indicó el fiscal que “Como parte de las acciones indagatorias llevadas a cabo por la Fiscalía se contempló la realización de los protocolos establecidos en la Ley 21.057 de Entrevista Investigativa Videograbada que busca evitar la victimización secundaria en niñas, niños y adolescentes víctimas de delitos graves. Para lo cual la Fiscalía Local de Vallenar las desarrolló, siendo el segundo caso en la comuna en que éstas se aplican en juicio obteniendo en ambas sentencias condenatorias en contra de los acusados”.
Puntualizó además Zolezzi Briones que una vez que reunió las pruebas el caso fue sometido a audiencia de Juicio Oral, instancia judicial en que la Fiscalía pudo acreditar la responsabilidad penal del acusado en contra de quien los Jueces del mencionado Tribunal determinaron condenar por su responsabilidad, en calidad de autor, del delito de abuso sexual reiterado.

Así, en la audiencia de lectura de sentencia se conoció que el Tribunal aplicó la pena de 5 años y un día de presidio efectivo, además quedará sujeto a la vigilancia de la autoridad por los 10 años siguientes al cumplimiento de la condena, debiendo informar su domicilio cada tres meses a personal de Carabineros.
