Abogado Manuel Corrales presenta recurso de protección por tala de árboles en El Pretil
El ex Gobernador y abogado Manuel Corrales González presentó un recurso de Protección ante la Ilustrísima Corte de Apelaciones de Copiapó por la tala de árboles registrada en el parque El Pretil.
Al respecto de la medida judicial solicitada, el profesional señaló que “en el día de ayer (lunes) se interpuso un recurso de protección con una solicitud de orden de no innovar para poder paralizar los trabajos que se están realizando en la renovación del parque El Pretil, debido a la tala indiscriminada de árboles y que solicitamos ante la Corte que sean los organismos técnicos que correspondan, tales como Conaf, el Seia, tengan ellos que presentar un informe que si lo que se está realizando está de acuerdo al ordenamiento jurídico de nuestro país. Esto porque no podemos permitir que esta tala que nos afecta a la gran mayoría de los copiapinos, se siga produciendo; porque tenemos información,-y eso es lo que tienen que corroborar según los informes que solicite la Corte-, de que existirían más árboles estarían en el listado que iban a cortar; no solamente que estuvieran secos o muertos, sino también árboles que iban a ser cortados por un tema arquitectónico que ahí en ese lugar iba a ir un tipo de construcción. Eso no lo podemos permitir, había un árbol de más de 60 años, y que de un momento a otro se corte un árbol que notoriamente no estaba ni seco, ni hueco, ni muerto, es un atentado en contra de un ser vivo. Así es que lo poco y nada de árboles que tenemos, lo debemos cuidar”.
Ahondando en conceptos el abogado dijo que “el tribunal tiene un plazo para poder admitir el recurso, y ver si nos da la orden de no innovar; si es así, le envíe un informe a los organismos correspondientes y un informe a la Municipalidad de Copiapó para que tanto la Municipalidad como la empresa contratista que está realizando los trabajos indiquen porqué, cómo y cuántos árboles van a cortar en el proyecto en cuestión”.
Además recalcó la necesidad de que exista participación y consulta a la comunidad, en proyectos de tal magnitud como la renovación del parque El Pretil. “Siempre he sido de la idea de que los caminos nos tienen que llevar a un camino de la paz, del diálogo y del entendimiento. El camino en sí, yo como abogado es siempre dentro de los parámetros que da el ordenamiento jurídico; y en este caso, el recurso de protección es nuestra arma, nuestra forma de poder pedir a un tercero imparcial, como es la Ilustrísima Corte de Apelaciones, que diga que si el acto de la Municipalidad o de la empresa es ilícito o arbitrario. Así es que son ellos los que tienen que dilucidar cuáles son los caminos a seguir, y si la Municipalidad actuó conforme a derecho”.
Recalcó Manuel Corrales que “es importante señalar que una cosa, que a lo mejor puede ser estando dentro de los parámetros legales, pero sí esto nos tiene que enseñar que un proyecto tan grande, de más de 6 mil millones de pesos tiene que realizarse una consulta ciudadana; porque es un proyecto que nos afecta a todos, y que no se puede cambiar de un día para otro.
Fue enfático en acotar el abogado que “el Alcalde lo que pretende en su reacción a la forma en que reaccionó la población, es paralizar los trabajos y paralizar la tala de estos árboles. Lo realiza porque sabe que no corresponde, que no se debe hacer; pero la mejor forma para evitarnos esto es que estos proyectos grandes que van a ser por muchos años sean aprobados y que tengan el respaldo de la ciudadanía”.
También se refirió y criticó las obras desarrolladas en anteriores gestiones del edil copiapino, y que finalmente causaron disgusto a la población copiapina, “eso se realiza mediante una consulta ciudadana, porque no queremos repetir, como nos ha pasado con la administración del señor Marcos López en que hay una plaza que a la gente no le gusta, que recuerdan esos espejos de agua, recuerdan esa plaza familiar, que recuerdan que era una de las plazas más lindas de Chile; recuerdan la reja del Puente La Paz, recuerdan unas calles más anchas en el centro de Copiapó y todo esto es algo que disgusta y que divide a la población”.
