Tras apelación ante Corte de Apelaciones de Copiapó: Defensora penal pública logra pena sustitutiva de libertad vigilada intensiva

Tras apelación de la defensora penal pública, Marcia Guzmán Godoy, ante la I. Corte de Apelaciones de Copiapó, esta revoca sentencia del Tribunal de Garantía de la misma ciudad, dictada en el mes de abril recién pasado y concede al sentenciado J.V.C. la pena sustitutiva de libertad vigilada intensiva.                                                                                                                          “Mi cliente, en esa ocasión, aceptó un procedimiento abreviado, donde la Fiscalía solicitó se aplicara la pena de 3 años y 1 día, pero se opuso a libertad vigilada. En dicha audiencia se solicitó al Juez sustituyera la pena privativa de libertad por la pena sustitutiva, ya que cumpliría los requisitos de la Ley 18.216, pero no accedió, condenándolo a pena efectiva, ya que a su juicio no existían antecedentes suficientes para concederla, pero se invocó un informe social que se había acompañado oportunamente a la carpeta judicial, que contenía factores positivos, que le permitirían el cumplimiento de una condena en libertad, por lo cual interpuse un recurso de apelación ante a la Ilustrísima Corte de Apelaciones de Copiapó”, enfatizó la Defensora.                                          

El informe social, redactado por la perito, asistente social, declara que J.V.C presenta factores positivos para suponer su reinserción social: posee proyección a futuro frente a su área laboral, familiar y económica; posee conciencia de su consumo de sustancias ilícitas y es por esto que se interna en un sistema residencial de SENDA, en donde permanece por un año; posee estudios de enseñanza básica y media y un curso de gasfitería domiciliaria y él es un agente importante para el ingreso familiar.                         

Guzmán Godoy agregó que “además mi cliente reunía todos y cada uno de los requisitos establecidos en el artículo 15 y 15 bis de la Ley N° 18.216; la pena que se le impuso no excede de 5 años, tiene antecedentes penales anteriores prescritos, y aceptó los hechos de la acusación, los antecedentes de la investigación y colaboró con el esclarecimiento de los hechos, lo que hace presumir que esta pena lo disuadirá de cometer nuevos delitos”. 
                                                                                                   
 J.V.C queda sujeto a las condiciones previstas en el artículo 17 de la Ley N° 18.216, por lo que el Tribunal a quo fijará una fecha de presentación ante el Centro de Reinserción Social de Copiapó, para el inicio del cumplimiento de su pena sustitutiva.
