Ministerio de las Culturas impulsa Encuesta Online sobre proyecto de Ley de Patrimonio Cultural
El Ministerio de las Culturas, las Artes y el Patrimonio invita a la ciudadanía, comunidades y actores interesados a participar de una Encuesta Online en torno al proyecto de Ley de Patrimonio Cultural que se encuentra en su primer trámite constitucional.
El proyecto fue ingresado al Congreso Nacional en junio de 2019 y busca actualizar la ley N°17.288 de Monumentos Nacionales, que data de 1970 y a la vez consolida una normativa de 1925, no habiéndose experimentado cambios sustanciales en la materia en un periodo de casi 100 años.
“Durante estos 10 meses de diálogo y escucha se han recibido aportes y puntos de vista muy valiosos. Se han confirmado de manera muy clara los ejes centrales del proyecto, como la necesidad de descentralizar la gestión del patrimonio y sumar nuevas herramientas y recursos, y al mismo tiempo han surgido propuestas que creemos enriquecerán sustancialmente la iniciativa. Por ello, hemos decidido ingresar próximamente una indicación sustitutiva que reemplazará al proyecto de ley original, para incorporar buena parte de estas propuestas y continuar así la tramitación legislativa”, explica la ministra de las Culturas, las Artes y el Patrimonio, Consuelo Valdés.
La autoridad agrega que de cara al ingreso de la indicación sustitutiva se está llevando adelante una nueva instancia de consulta ciudadana en torno a la iniciativa: “Estamos impulsando un proceso de participación abierto a la ciudadanía a través de una encuesta online en torno a las principales temáticas del proyecto que han sido levantadas en estos meses de debate público. Están todos invitados a ser parte para seguir enriqueciendo juntos un proyecto que es urgente y fundamental. El patrimonio no puede seguir esperando, el marco legal y las herramientas que nos rigen hace 100 años no son suficiente y llegó la hora de hacer los cambios en un diálogo amplio y constructivo”.
La Encuesta Online – Hacia una Ley de Patrimonio Cultural compara la legislación patrimonial vigente con las propuestas que se consideran en la próxima indicación sustitutiva, en relación a los siguientes temas: Institucionalidad del patrimonio cultural; Marco conceptual y categorías de protección; Protección efectiva y gestión del patrimonio cultural; Sanciones por infracciones, fiscalización, supervigilancia y delitos contra el patrimonio cultural; Procedimientos administrativos y participación ciudadana; y Educación y difusión del patrimonio cultural.
La Encuesta -que estará en línea hasta el 29 de mayo de 2020- se enmarca y suma al trabajo legislativo en la Comisión de Cultura de la Cámara de Diputados. En acuerdo con los parlamentarios se ha avanzado en esta primera etapa sin establecer urgencias legislativas, con el propósito de dar los espacios necesarios para escuchar a todos los actores, instituciones y personas que se han sumado al debate a través de las audiencias públicas que hace más de 10 meses se realizan en el Congreso.
Para profundizar la discusión y levantar nuevas voces, durante este tiempo el Ministerio ha impulsado procesos complementarios. Se desarrollaron instancias de trabajo técnicas con representantes de la sociedad civil y expertos en materias específicas del proyecto; Encuentros Regionales abiertos para levantar miradas y propuestas locales organizados por las seremias; una Comisión con miembros del Consejo Nacional de las Culturas, las Artes y el Patrimonio, mesas de trabajo con integrantes del Consejo de Monumentos Nacionales y otra entre los equipos del Ministerio y los parlamentarios de la Comisión, entre otras.
“Hemos tenido un debate profundo que ahora se amplía con esta encuesta pública. Muchos han participado de este debate, planteando sus posturas, sugerencias y visiones y eso es una buena noticia porque es reflejo de que el cuidado y la proyección del patrimonio es algo que nos importa a todos. Chile, sus comunidades y localidades necesitan urgente una nueva ley de patrimonio y estamos comprometidos en esa tarea”, agrega la ministra Valdés.
El proyecto de ley busca generar una protección efectiva del patrimonio y para eso propone tres ejes principales: descentralizar y empoderar a las regiones respecto a la gestión de su patrimonio; entregar herramientas y recursos para su mantención, puesta en valor y salvaguardia; y superar la visión netamente monumental o material del patrimonio para integrar y reconocer el patrimonio inmaterial, como lo son las prácticas y saberes, y otras categorías de protección como los paisajes culturales o los sitios de memoria.
