En fallo dividido, la sala del Primer Tribunal Ambiental integrada por los ministros Mauricio Oviedo (presidente), Marcelo Hernández y Juan Opazo, rechazó la reclamación de vecinos de Puerto Viejo en contra del Servicio de Evaluación Ambiental, SEA, por la calificación favorable del proyecto ENAPAC que se construirá en la Región de Atacama.

La sentencia ratifica la decisión del SEA que dio luz verde a la construcción de una planta desaladora, ductos y una planta fotovoltaica en la comuna de Caldera.

La sentencia detalla los puntos en controversia respecto a la participación ciudadana y el uso de suelo del lugar donde se ubicará el proyecto y explica por qué se desestimaron las alegaciones hechas por un grupo de pescadores de la caleta de Puerto Viejo, cercana al lugar donde se emplazará la planta.

Respecto a los hechos controvertidos el ministro presidente del Primer Tribunal Ambiental y redactor del fallo, Mauricio Oviedo, dijo que en lo que respecta a la participación ciudadana de los vecinos de la caleta, se pudo establecer que “el potencial desarrollo del proyecto no era una situación ajena o desconocida para los habitantes del sector”.

Lo anterior porque la empresa durante los años 2016 y 2017 desarrolló un total de 27 actividades de difusión, de las cuales a lo menos 11 se realizaron en la localidad y quedó establecido que en el contexto del relacionamiento comunitario llevado adelante por la empresa y luego de varias reuniones se formó una “mesa de trabajo” en la que participó el Sindicato de Pescadores y Buzos Mariscadores Nº 1 de Puerto Viejo.

 “No es posible sostener que los reclamantes hayan sido excluidos del proceso de participación ciudadana por el solo hecho de no haberse realizado un taller presencial en la localidad”, explicó Oviedo y acotó que “lo esencial del procedimiento de participación ciudadana es que la información relativa al proyecto que se pretende desarrollar sea conocida por la comunidad que habita en el área de influencia, lo que se logra no solo con la realización de talleres presenciales convocados por el Servicio de Evaluación Ambiental, SEA, sino que también a través de otros medios como la mesa de trabajo”.

El otro punto en controversia, que dice relación con la supuesta incompatibilidad del proyecto con el uso de suelo del Plan Regulador Intercomunal Costero, PRICOST, tampoco fue acogido porque se pudo determinar que el instrumento de planificación vigente a la hora de aprobar el proyecto, fue el PRICOTS 2001. “En este plan, la localización de las obras está en la zona ZUI-7 que corresponde a terrenos costeros, reservados para futuras extensiones de los centros poblados y para la infraestructura complementaria de los asentamientos humanos, por lo que no advertimos ilegalidad en la compatibilidad territorial del proyecto”, acotó el Ministro presidente.

Sin embargo, el fallo tuvo el voto de prevención y disidencia del Ministro en Ciencias, Marcelo Hernández, quien estimó pertinente acoger la reclamación respecto a la controversia de la compatibilidad territorial de la zona donde se ubicará el proyecto, al estimar que “existe un vicio esencial de legalidad “ y acota que “se vulnera el resguardo del bien jurídico ambiental en las zonas de dunas y de protección ecológica”, lo que haría necesario y obligatorio que se resguarden los objetos de conservación ambiental especiales como lo son el desierto florido, dunas y quebradas, singularidades paisajísticas y sitios de interés paleontológico.

PROYECTO El proyecto ENAPAC de la empresa Trends Industrial S.A. consiste en la generación de agua para uso industrial, la cual será almacenada en un reservorio de aproximadamente 592.000 m3 de capacidad conformado por dos piscinas de 296.000 m3 cada una. El agua de uso industrial será generada a partir de agua de mar, la cual será tratada en una planta desaladora de osmosis inversa que se emplazará contigua a la línea de costa. Luego el caudal será conducido al reservorio mediante un acueducto de 68 km. de longitud. Todos los procesos serán provistos de energía generada en una planta fotovoltaica de 100 MW. Está previsto que demore dos años en su fase de construcción y se espera opere por un plazo de 30 años.
