Cinco años y un día de cárcel para autor de robo con intimidación en Vallenar
Penas efectivas de cárcel obtuvo la Fiscalía de Atacama luego que presentara a audiencia de Juicio Oral los antecedentes de un delito de robo ocurrido en Vallenar el año pasado, instancia judicial que fue asumida por el fiscal adjunto de esta comuna, Roberto Robledo.
De acuerdo al contenido de la acusación, los hechos indagados ocurrieron el 06 de mayo del año pasado alrededor de las 15 horas. Ese día el imputado, Sebastián Godoy Garay (29), abordó al afectado en los momentos en que éste descendía de un bus de la locomoción colectiva en las cercanías de las calles Brasil con Sargento Aldea.
“De acuerdo a lo que pudo establecer la Fiscalía al dirigir la investigación, el acusado utilizó un arma de fuego que portaba para intimidar a la víctima a quien sustrajo el dinero que llevaba consigo al momento del delito. Luego de lo cual se alejó del lugar hacia las calles del centro de la ciudad”, dijo el fiscal.
Roberto Robledo agregó que con la oportuna denuncia del afectado, personal de Carabineros de esta ciudad detuvo al autor del robo quien al momento de advertir la presencia policial dejó caer un arma a fogueo. En este procedimiento y luego del registro de las vestimentas del imputado, los funcionarios encontraron 21 cartuchos balísticos calibre 9 milímetros aptos para ser disparados, además del dinero de propiedad de la víctima.
Los hechos indagados, además del testimonio del afectado y funcionarios que adoptaron el procedimiento, junto a otros medios de prueba, permitieron a la Fiscalía acreditar el delito y conseguir que los jueces de la Tercera Sala del Tribunal Oral condenaran a Godoy Garay por su calidad de autor del robo con intimidación y lo sentenciaran a la pena de 5 años y un día de cárcel, además de otros 541 días de presidio por el delito de porte ilegal de municiones. Sanciones penales que deberán ser cumplidas de manera efectiva en la cárcel de Vallenar.
